Terms of Use

These Terms of Use govern access to ProbateParalegalCA.com and its document-preparation portal (collectively, the “Site”). By creating an account, submitting a document request, accepting a quote, or using the Site, you agree to these Terms.

1. Limited Self-Help Service

The Site offers a limited document-preparation workflow for selected California probate and conservatorship documents. The available services are: supplements to petitions; declarations; status reports; petitions for final accounting and distribution; supplements to conservatorship petitions; and notices of hearing.

You choose the document you want prepared and provide the facts, case information, source documents, and instructions to be used. The Site does not decide what document you should file, what position you should take, what facts you should allege, or what legal strategy you should pursue.

2. No Legal Advice or Representation Through the Self-Help Site

The self-help service does not include legal advice, legal opinions, court representation, appearance at hearings, legal strategy, deadline calculation, or a determination that a particular filing is legally sufficient or appropriate. Use of the Site alone does not create an attorney-client relationship.

If you want legal advice or representation, you are encouraged to consult a licensed California attorney. Legal services, if offered, require a separate agreement with counsel and are not included in a document-preparation quote unless a separate written agreement expressly says otherwise.

3. Your Responsibility for Instructions and Accuracy

You are responsible for selecting the requested document and for the truth, completeness, and accuracy of the facts and instructions you provide. You must review every completed document before signing, filing, serving, or relying on it. You are responsible for correcting inaccurate information and for obtaining legal advice if you are unsure what information should be included.

4. Court Deadlines, Filing and Service

You are responsible for identifying and meeting all filing, service, notice, hearing, objection, response, and other deadlines unless a separate written service description expressly states otherwise. A quote or order status does not extend a court deadline. The Site does not guarantee that a court will accept, approve, or grant any document or request.

5. Quotes and Scope

After you submit a request, the Site may provide a quote based on the document selected, the information supplied, complexity, urgency, anticipated revisions, and other work reasonably required for that request. A quote covers only the scope stated with the quote. Additional work, additional documents, changed instructions, extensive revisions, or expedited work may require a revised or additional quote.

6. Payment

Payment may be made through a third-party hosted payment page identified in the portal. Do not enter or transmit full card or bank credentials through portal messages or uploads. Work may be held until payment is confirmed. Payment-provider terms also apply to transactions completed on the provider’s site.

7. Cancellations and Refunds

You may request cancellation before work begins. If work has begun, any refund will depend on the amount of work completed, nonrefundable third-party charges, and the specific quote or order terms. No refund is promised after a completed document has been delivered except where required by law or expressly stated in writing.

8. Revisions

Reasonable corrections that conform the document to the facts and instructions originally supplied may be included if requested promptly. New facts, new relief, a different document, a different legal theory, or substantial rewriting may constitute new work and may require a new quote.

9. Final Accounting and Distribution

A request for a Petition for Final Accounting and Distribution does not itself include preparation of the underlying accounting schedules unless expressly stated in the quote. Users who need a self-help accounting workspace may separately use AccountingCA.com. AccountingCA.com is a separate service.

10. User Accounts

You must provide accurate account information, protect your password, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account. We may suspend accounts used for fraud, abuse, unlawful conduct, security threats, or violations of these Terms.

11. Uploaded Materials

You represent that you have the right and authority to submit the information and documents you upload. Do not upload malware, unlawfully obtained information, or material unrelated to the requested service. You grant us permission to process the submitted material as reasonably necessary to perform and administer the requested service.

12. Electronic Communications

You consent to receive service-related communications electronically, including account notices, quote notices, requests for information, payment-status notices, and completion notices. You are responsible for keeping your email address current and checking your portal.

13. No Guarantee of Outcome

Courts may require corrections, additional facts, different forms, additional notice, appearances, or other action. We do not guarantee acceptance by a clerk, approval by a judge, a particular hearing result, or any legal outcome.

14. Availability

We may modify, suspend, or discontinue Site features for maintenance, security, legal compliance, or business reasons. The Site is not intended for emergency filings or situations where immediate access is essential. Maintain your own copies of important documents.

15. Intellectual Property

The Site design, software, text, workflow, and branding are protected by applicable intellectual-property laws. You may use completed documents for your own lawful matter. You may not copy, scrape, resell, reverse engineer, or commercially exploit the Site or its software except as permitted by law.

16. Disclaimer and Limitation

To the fullest extent permitted by law, the Site is provided on an “as available” basis without a guarantee that it will be error-free or uninterrupted. Nothing in these Terms excludes obligations or remedies that cannot lawfully be waived. Any limitation of liability will be applied only to the extent permitted by applicable law.

17. Governing Law

These Terms are governed by California law, without regard to conflict-of-law principles. Any venue or dispute provision must be applied subject to applicable consumer-protection law and any nonwaivable rights.

18. Changes

We may revise these Terms. The effective date above will be updated when changes are posted. Material changes may also be communicated through the portal or by email when appropriate.
